                                                                               OUR STATUTES

Article 1 Name

Our association, governed by the law of July 1, 1901 and the decree of August 16, 1901, is named "ANANDA, les YOGIS du monde".

Article 2Objectives

The association offers free postural Yoga practices as well as activities promoting well-being, such as meditation, sophrology, and clothed wellness massages to people in precarious situations or from disadvantaged backgrounds who are unfamiliar with or do not have easy access to these practices, particularly unaccompanied foreign minors, refugees, and youth in difficulty.

Article 3Duration

The association's duration is unlimited

Article 4Registered Office

The registered office is located at 75 rue de Tolbiac, 75013, Paris, FRANCE. It may be transferred by simple decision of the board, after ratification by the general assembly.

Article 5Composition of the Association

The association consists of different types of members:

  • Active members: Those who provide Yoga classes, sophrology sessions, meditation, massages, or participate in the proper functioning of the association. They pay their annual membership fee and participate in general assemblies.

  • Honorary members: This title is given by board members to individuals who render or have rendered services to the association. Honorary members are exempt from paying membership fees and have privileged access to events organized by the association.

 

Article 6 Membership Fee

The minimum fee due by members, except honorary members, is determined by the internal regulations and is paid per calendar year. Its amount may be modified by the general assembly. Non-payment of the fee is equivalent to presumed resignation.

 

Article 7Admission Rules

Any person who wishes and shares the association's values can be a member. He/she commits to respecting the cultural differences of the people to whom the association's activities are addressed. Each active or benefactor member agrees to respect the statutes, the internal regulations and the volunteer charter of the association, and to pay the annual membership fee. Active members practicing Yoga, sophrology, and wellness massages must hold a diploma corresponding to the activity performed.

Article 8 Removal Rules

  • By death.

  • By resignation addressed in writing to the association's president.

  • By failure to comply with the rules established in the statutes, internal regulations, and volunteer charter. Removal is pronounced by the general assembly, convened by the association's president.

  • By non-renewal of membership.

 

Article 9Member Responsibility

No member of the association is responsible for commitments made by it. Only the association's assets are liable for its commitments.

Article 10Board

The general assembly elects from among its members a board comprising:

  • A president;

  • A secretary;

  • An assistant secretary;

  • A treasurer.

 

Article 11Roles of Board Members

The board has full management and administrative power of the association. Board members are elected for one year and are re-eligible. They have the following missions:

  • The president carries out the association's declaration and all subsequent publications (as required by the law of July 1, 1901 and the decree of August 16, 1901). They direct the association's activities and ensure its functioning, notably by convening the general assembly, presenting the activity report, and ensuring the implementation of decisions taken during general assemblies. They represent the association externally.

  • The secretary and assistant secretary make available to association members the minutes of general assembly meetings and any other document necessary for its proper functioning. They draft the minutes of general assemblies and handle the association's correspondence.

  • The treasurer keeps the association's accounts.

Board members meet as often as necessary upon convocation by the president or other board members. The board can authorize all acts and operations permitted to the association that are not reserved for ordinary or extraordinary general assemblies.

 

Article 12Compensation of Board Members

The functions of board members are free and voluntary.

Expenses and disbursements incurred in the performance of their mandate may be reimbursed upon presentation of supporting documents.

 

Article 13Ordinary General Assembly

The Ordinary General Assembly (GA) includes active members of the association and meets once a year. The president sends an email convocation presenting the agenda to the various members fifteen days before the set date.

The GA board corresponds to that of the association.

The president chairs the GA and presents the association's moral situation. The treasurer reports on their management and submits the financial statement to the GA.

The GA deliberates regardless of the number of members present, and decisions are taken by a majority vote of members (present or represented by proxy). All deliberations are taken by show of hands.

The ordinary GA elects board representatives for the coming year and deliberates on future orientations.

GA decisions are binding on all members, including absent or represented members.

 

Article 14 – Extraordinary General Assembly

The Extraordinary GA (EGA) is convened by the association's president.

It rules on modifications to the statutes, the possible dissolution of the association, the removal of a member, or any other subject. For these decisions, a three-quarters majority of present and represented members is required.

Article 15Procedures for Modifying Statutes

Modification of statutes is pronounced at the request of the board and ratified by an extraordinary GA. The new statutes must be signed by all board members.

 

Article 16 Internal Regulations and Volunteer Charter

Internal regulations and the volunteer charter are established by the board and then approved by the ordinary GA. These regulations set various points not provided for in the statutes (internal administration of the association). They stipulate the amount of membership fees. The volunteer charter informs about the moral commitment of volunteers and is also established by the board.

 

Article 17Dissolution Procedures

Dissolution is pronounced at the request of the board and ratified by an EGA. The latter designates one or more liquidators who will be responsible for liquidating the association's assets.

Association members may not be attributed, apart from the recovery of their contributions, any part of the association's assets. The remaining assets will be mandatorily attributed to one or more associations pursuing similar goals.

 

Article 18Resources

The association's resources include:

  • The amount of paid membership fees;

  • ​donations

  • Subsidies from all communities;

  • Contributions from foundations;

  • Proceeds from solidarity services and charity events;

  • Revenues from exceptional events, such as Yoga classes, massage and sophrology sessions, shows, photo exhibitions;

  • Sums received in exchange for goods sold or services provided;

  • ​merchandising

  • Any other resources that would not be contrary to laws in force.

INTERNAL REGULATIONS

Any volunteer joining the association agrees to acknowledge and respect the following points:

Membership Fee

Membership to the « ANANDA, les YOGIS du monde » association, is achieved by paying an annual fee of 10 euros. It is valid for one calendar year and must be paid at the beginning of each new year before the end of the first quarter of the calendar year. It can be paid in person, by check or bank transfer, or via the Cotizup collection. Failure to pay the membership fee is equivalent to a presumed resignation.

Membership and Insurance

Through their membership, the volunteer is covered by liability insurance for the activities entrusted to them and subscribed by the association.

General Assembly (GA)

No quorum is required for the GA. Proxy votes are accepted. Thus, votes will include those of members present and represented (mandated another person to attend and vote at the GA on their behalf). New decisions will be adopted if a simple majority is reached.

Reimbursements

Any expense for the association must be made after prior validation by a referent. No reimbursement will be made without their validation and without presentation of proof (receipt or invoice) to the treasurer.

Health

Any injury or damage that may have occurred during volunteer time within the association must be reported to the association.

Loss of Membership Status

Membership status is lost by non-renewal of the annual fee or by exclusion pronounced by the board for serious reasons, acts or attitudes contrary to the aims of the association and after giving the person concerned the opportunity to explain themselves.

​​​​​Each volunteer commits to:

  • Welcome new volunteers when they join the association, and inform them about the particularities of our actions with young exiles.

  • Listen to the difficulties encountered by volunteers during our field actions and propose possible solutions.

  •  Respect the people we meet (regardless of their gender, sexual orientation, religion, nationality, or any other discriminating characteristic). Massages will be performed over clothing to respect the integrity, modesty, and culture of the people being massaged. Any situation that does not respect these conditions will result in exclusion from the association.

  • Respect the members of ANANDA, les YOGIS du monde, as well as those of other charitable organizations.

  • Keep confidential the life stories and other personal information that may become known to the volunteer during their activity.
